2. Description of Services

1stay.in is an online platform that connects travelers with accommodation providers. Our Services include:

• Search and discovery of accommodation options
• Booking and reservation management
• Payment processing and transaction facilitation
• Customer support and assistance
• User reviews and rating systems
• Communication tools between guests and hosts

We act as an intermediary between guests and accommodation providers. We do not own, operate, or control any of the accommodations listed on our platform.

3. User Accounts and Registration

Account Creation

To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You are fully responsible for all activities that occur under your account
• We reserve the right to suspend or terminate accounts that violate these Terms

Eligibility

4. Bookings and Payments

Booking Process

• All bookings are subject to availability and confirmation
• Prices are displayed in the currency specified and may include taxes and fees
• Special requests are not guaranteed and are subject to property availability
• You must provide accurate guest information for all bookings

Payment Terms

• Payment is required at the time of booking unless otherwise specified
• We use third-party payment services including PhonePe, UPI gateways, and banking partners such as Axis Bank or other authorized banks
• All online payments are processed securely through our trusted payment gateway providers
• Additional charges may apply for certain services or amenities

Cash Payments and Refunds

• Any cash transactions paid directly to the property owner cannot be claimed for refund through our platform
• For cash payments, we can only maintain records but cannot process refunds through our channel
• Refunds for online payments will be processed within 7-10 business days, subject to bank processing times
• Refund timelines may extend beyond 10 days during bank holidays or due to banking procedures

Pricing and Fees

Prices displayed on our platform are provided by accommodation providers and may change without notice. We may charge service fees for our platform usage, which will be clearly disclosed before booking completion.

Booking Confirmation

Upon successful booking, you will receive a confirmation email with your booking details. This confirmation serves as your receipt and contains important information about your reservation.

5. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

Prohibited Content

• Posting false, misleading, or fraudulent information
• Uploading content that violates intellectual property rights
• Sharing inappropriate, offensive, or harmful content
• Posting spam or unsolicited promotional material

Prohibited Behavior

• Attempting to circumvent our booking or payment systems
• Using automated tools to access or scrape our platform
• Interfering with the proper functioning of our Services
• Impersonating other users or entities
• Violating applicable laws or regulations

Reviews and Ratings

Reviews must be honest, accurate, and based on your actual experience. Fake reviews, review manipulation, or reviews that violate our content guidelines may result in account suspension or termination.

6. Cancellation and Refund Policy

Cancellation by Guests

• Cancellation policies vary by property and are set by accommodation providers
• Specific cancellation terms are displayed during the booking process
• Refunds, if applicable, will be processed according to the property's policy
• Service fees may be non-refundable depending on the cancellation timing

Cancellation by Properties

In rare cases, accommodation providers may need to cancel confirmed bookings. In such situations, we will assist in finding alternative accommodations or processing full refunds.

Force Majeure

Neither party shall be liable for any failure to perform due to unforeseen circumstances or causes beyond their reasonable control, including but not limited to natural disasters, government actions, or other force majeure events.

7. Limitation of Liability and Disclaimers

Service Disclaimer

Our Services are provided "as is" and "as available" without warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of any content on our platform.

Third-Party Services

We are not responsible for the quality, safety, or legality of accommodations listed on our platform. Accommodation providers are independent third parties, and we do not control their services or facilities.

Limitation of Damages

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of our Services.

8. Termination

Termination by You

You may terminate your account at any time by contacting our customer support team. Upon termination, your access to certain features may be restricted, but existing bookings will remain valid.

Termination by Us

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

Effect of Termination

Upon termination, your right to use our Services will cease immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Dispute Resolution
